Application Terms of Service

1. Acceptance of Terms

By accessing or using ProgramLive ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ProgramLive provides a multi-tenant, cloud-based platform for organizing, managing, and synchronizing live event agendas in real-time.

3. YouTube API Integration

ProgramLive utilizes YouTube API Services. By authenticating your YouTube account within our Service, you agree to comply with the YouTube Terms of Service and acknowledge the Google Privacy Policy.

4. User Responsibilities & Intellectual Property

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials and OAuth tokens.
  • Content Ownership: You retain all intellectual property rights to the content, agendas, and media you upload to AWS S3 via our Service. ProgramLive claims no ownership over your event data.
  • Broadcast Rights: You are solely responsible for ensuring you possess the necessary rights, licenses, and permissions for any audio, video, or intellectual property transmitted via YouTube broadcasts created through ProgramLive. ProgramLive assumes no liability for copyright strikes, content ID claims, or account terminations imposed by YouTube.

5. Limitation of Liability for API Failures

ProgramLive interacts with third-party APIs (including Google and YouTube). We are not liable for any disruptions, delays, or failures in your live broadcasts resulting from:

  • Downtime or rate-limiting from YouTube API Services.
  • Changes in Google's API policies or deprecation of endpoints.
  • Network latencies outside of our direct server infrastructure.

6. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your internal business, organizational, or personal event management purposes in accordance with your subscription plan.

7. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

8. Changes to the Service and Terms

ProgramLive is a permanently evolving SaaS. We reserve the right to modify or discontinue features at any time. We will notify users of significant changes to these Terms. Continued use of the Service following such changes constitutes your acceptance.

9. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which ProgramLive's parent company is registered, without regard to its conflict of law provisions.
